1. Introduction and Definitions
GETT3D Software Solutions Corp., operating as AutoQuote3D ("GETT3D", "AutoQuote3D", "we", "our", or "us"), provides you ("you", the "user") a service for the automation of quoting and customizing 3D prints as well as 3D printing order flow (the "AutoQuote3D Service" or "Service").
The Service may be accessed through the following channels (each an "Access Channel"):
- The Widget: a small software module operating within or connecting to the AutoQuote3D environment and appearing on a Web Site of your designation, which provides you and your customers with a customer-facing quoting service;
- The Web Application: the AutoQuote3D administration interface available at app.autoquote3d.com;
- The Public API: our REST application programming interface, authenticated by API keys issued to your account, that allows you to access and manage your account and its data through your own software applications;
- The MCP Server: our Model Context Protocol ("MCP") server, authenticated through your AutoQuote3D account sign-in (OAuth), that allows you to access and manage your account through AI assistants and AI-powered tools (e.g., Claude, ChatGPT, and similar services) ("AI Assistants").
The Public API and MCP Server are together referred to as the "Programmatic Interfaces". References in these Terms to the Service include all Access Channels unless stated otherwise.
2. Acceptance of Terms
By accessing or using the AutoQuote3D Service through any Access Channel, you agree to comply with and be bound by these terms and conditions ("Terms"). If you do not agree to these Terms, you should not use the AutoQuote3D Service.
3. License and Use of Service
Subject to these Terms, GETT3D grants you a revocable, limited, non-exclusive, non-transferable license to:
- Access and use the AutoQuote3D Service for your internal business purposes;
- Install and use the Widget on Web Sites and devices you own or control;
- Access the Service programmatically through the Programmatic Interfaces using credentials issued to your account.
All ownership rights, including patents, copyrights, trademarks, trade secrets, and source code, remain with GETT3D. Updates to the Service, Widget, or Programmatic Interfaces are governed by these Terms.
Prohibited uses. You may not:
- Use the Service for any illegal or unauthorized purpose, or violate any laws in your jurisdiction in connection with your use of the Service;
- Copy, modify, distribute, sell, lease, share, resell, or otherwise commercialize any part of the Service, the Widget, or the Programmatic Interfaces;
- Reverse engineer, decompile, or attempt to extract the source code of the Service;
- Modify, hack, or attempt unauthorized access to the Service or the accounts of others;
- Use the Service to infringe on privacy or intellectual property rights;
- Post or store malicious, unlawful, or discriminatory content;
- Circumvent rate limits, usage limits, or other technical restrictions on any Access Channel, including through automated or AI-driven access.
4. Widget Installation
- Requirements: You are responsible for properly installing the Widget on your Web Site according to the instructions provided by GETT3D.
- Maintenance: You are responsible for maintaining the Widget and ensuring that it operates correctly on your Web Site.
5. Programmatic Interfaces: Public API, MCP Server, and AI Assistant Access
AutoQuote3D provides Programmatic Interfaces that allow you to connect your own software and third-party tools, including AI Assistants, to your account. The following terms apply to all programmatic access:
- Your credentials, your responsibility. Access to the Programmatic Interfaces requires credentials associated with your account — API keys for the Public API, and OAuth authorization through your AutoQuote3D sign-in for the MCP Server. You are responsible for safeguarding these credentials and for all activity performed using them, including activity initiated by applications or AI Assistants you have connected. Do not embed API keys in client-side code or share credentials with parties you do not trust with access to your account.
- Programmatic actions are your actions. Any action taken on your account through a Programmatic Interface — including creating quotes, uploading files, changing prices, modifying materials or machines, updating orders, applying discounts, changing store settings, or sending quotes and checkout links to your customers by email — is deemed an action taken by you. You are solely responsible for reviewing and confirming actions initiated through connected software or AI Assistants, and for any resulting quotes, prices, orders, customer communications, or data changes.
- Third-party AI providers. AI Assistants are provided by third parties and are subject to their own terms and privacy policies. When you connect an AI Assistant to the Service, data from your account (including Customer Data) may be transmitted to and processed by that AI provider. GETT3D does not control, and is not responsible for, the acts, omissions, outputs, or data-handling practices of third-party AI providers. You are responsible for ensuring your use of AI Assistants with the Service complies with applicable law and with your own obligations to your customers.
- No warranty on AI outputs. GETT3D does not warrant the accuracy, completeness, or suitability of any output, recommendation, summary, or action generated by an AI Assistant, even where that output is derived from data provided by the Service. AI-generated quotes, prices, and communications should be reviewed before being relied upon or sent to customers.
- Your applications. If you build applications on the Public API, you are solely responsible for those applications, including their security, reliability, and compliance with law. Your application must not misrepresent its relationship with AutoQuote3D or suggest endorsement by GETT3D. You may not use the Programmatic Interfaces to build a product that competes with the Service or to provide Service access to any individual or company other than your own.
- Versioning and deprecation. The Public API is versioned. We may modify, version, deprecate, or discontinue API or MCP Server endpoints; where a change is materially breaking, we will use commercially reasonable efforts to provide advance notice. Endpoints or versions designated as v0, beta, preview, or experimental may change without notice.
- Client libraries. We may publish client libraries and contract packages (such as our TypeScript client) to facilitate use of the Public API. These are provided "as is" under the license accompanying each package and form part of the Service for the purposes of these Terms.
- Rate limits and technical controls. Programmatic access is rate-limited. We may impose and modify rate limits, usage quotas, and other technical restrictions — which may vary by subscription tier — to protect the stability and security of the Service. Excessive or abusive programmatic access, or attempts to circumvent these controls, may result in throttling, suspension, or termination of access without notice.
- Revocation. You may revoke an application's or AI Assistant's access to your account at any time through your account settings, by rotating or deleting API keys, or by revoking OAuth authorizations. GETT3D may suspend or revoke access to the Programmatic Interfaces (in whole or for specific applications or keys) where we reasonably believe such access poses a security risk, violates these Terms, or harms the Service or other users.
- Availability. The Programmatic Interfaces are provided on the same "as is" and "as available" basis as the rest of the Service and are subject to the same Service Limitations, Disclaimer of Warranties, and Limitation of Liability.
6. Privacy Policy
Your use of the AutoQuote3D Service is also governed by our Privacy Policy.
GETT3D Software Solutions Corp. o/a AutoQuote3D ("we," "our," or "us") is committed to protecting your privacy. This Privacy Policy outlines how we collect, use, disclose, and safeguard your information when you use our AutoQuote3D software service (the "Service"). By accessing or using the Service, you agree to the terms of this Privacy Policy.
Information We Collect
We may collect the following types of information:
- Personal Information: Information that identifies you as an individual, such as your name, email address, phone number, billing information, and company name, provided when you register for the Service or communicate with us.
- Usage Data: Information about how you interact with the Service, such as IP address, browser type, operating system, access times, pages viewed, and API/MCP request logs.
- Customer Data: Data you or your users provide to us while using the Service, which may include uploaded files, configurations, and other information entered into the platform.
- Payment Information: Details required to process transactions, such as credit card or payment account details. Payment processing is conducted via third-party providers and subject to their privacy policies.
How We Use Your Information
We use the collected data to:
- Provide, operate, and maintain the Service;
- Process transactions and send invoices or payment confirmations;
- Communicate with you regarding updates, promotions, or service-related announcements;
- Analyze usage to improve functionality and user experience;
- Ensure security, detect fraud, and comply with legal obligations.
How We Share Your Information
We may share your information with:
- Service Providers: Third-party vendors who assist us in providing the Service, such as payment processors, hosting providers, and analytics services.
- Connected Applications: Where you connect a third-party application or AI Assistant to your account via the Programmatic Interfaces, data from your account will be shared with that application at your direction. Such sharing is governed by the third party's own terms and privacy policy.
- Legal Authorities: If required by law or if we believe disclosure is necessary to protect our rights, comply with legal processes, or address security concerns.
- Affiliates: Entities within our corporate group to support operations.
We do not sell or rent your personal information to third parties.
Your Customers' Data
Where you use the Service to collect information from your own customers (for example, uploaded files, quote requests, and order details), you are responsible for that data and for providing your customers with appropriate privacy disclosures. GETT3D processes such Customer Data on your behalf to provide the Service. This includes any transmission of Customer Data to AI Assistants that you choose to connect to your account.
Data Retention and Security
- Data Retention: We retain your information only for as long as necessary to fulfill the purposes outlined in this policy or comply with legal requirements.
- Data Security: We implement appropriate security measures to protect your data from unauthorized access, alteration, disclosure, or destruction. However, no method of transmission over the internet or electronic storage is 100% secure, so we cannot guarantee absolute security.
Your Rights and Choices
You have the following rights regarding your data:
- Access and Correction: You may access or correct your information through your account or by contacting us.
- Data Deletion: You may request the deletion of your personal information, subject to our retention obligations.
- Opt-Out: You may opt out of promotional communications by following the unsubscribe instructions provided.
Depending on your jurisdiction, you may have additional rights under applicable privacy laws (such as PIPEDA, the GDPR, or the CCPA), including rights of access, portability, restriction, and objection. To exercise these rights, contact us at the address below.
International Data Transfers
If you access the Service outside of Canada or the United States of America, your data may be transferred to and processed in Canada and/or the United States of America, where data protection laws may differ from those in your jurisdiction. By using the Service, you consent to such transfers.
Children's Privacy
The Service is not intended for individuals under the age of 18. We do not knowingly collect personal information from children. If we become aware that a child under 18 has provided personal information, we will delete it.
Updates to This Policy
We may update this Privacy Policy from time to time. We will notify you of any material changes by posting the revised policy on our website with an updated "Last Updated" date. Your continued use of the Service after such changes constitutes your acceptance of the updated policy.
7. Disclaimer of Warranties
The AutoQuote3D Service is provided "as is" and "as available" without any warranties of any kind, whether express or implied. GETT3D does not guarantee that the Service will be uninterrupted, secure, or error-free.
From time to time we may offer features identified as beta, preview, or early access. Such features are provided for evaluation, may be changed or withdrawn at any time, and are excluded from any availability or support commitments.
8. Limitation of Liability and Indemnity
Under no circumstances will GETT3D be responsible for any indirect, incidental, special, or consequential damages, including loss of profits, revenues, data, usage, goodwill, or other intangible losses. This includes situations such as:
- Your ability or inability to access or use the Service through any Access Channel;
- Actions or content from third parties while using the Service, including third-party AI providers and AI Assistants;
- Content obtained from the Service, or outputs generated by AI Assistants using data from the Service; or
- Unauthorized access, use, or alteration of your transmissions or content.
Regardless of the circumstances, GETT3D's total liability is capped at the total amount you paid for the Service within the 12 months preceding the claim. We're committed to providing a great experience, but we want to make sure you're aware of the limits of our liability to keep things clear and transparent.
You agree to indemnify and hold harmless GETT3D and its team from any claims, liabilities, losses, or damages, including reasonable attorney fees, resulting from violations of these Terms or third-party rights, including intellectual property rights, by you, your customers, or software (including AI Assistants) acting on your behalf.
9. Service Limitations
We strive to make our Service available 24 hours a day, 7 days a week, using commercially reasonable efforts to ensure you can rely on it whenever you need it. While we work hard to maintain accessibility, we cannot guarantee uninterrupted availability and may not always be able to provide maintenance, technical support, or updates unless these are included in your selected plan.
Whenever possible, we aim to provide at least 24 hours' notice for any scheduled downtime to minimize disruptions. If your use of the Service — including use through the Programmatic Interfaces — negatively impacts its performance for other customers or breaches these Terms, we may temporarily suspend or terminate account access to maintain a smooth experience for everyone.
10. Payment and Subscription
10.1 Subscription Period
The subscription period ("Subscription Period") for Accounts may be yearly or monthly. The Subscription Period begins at the time of Account registration and authorization of payment.
10.2 Subscription Fees
All Accounts incur fees ("Subscription Fees") based on the terms chosen by the user. The Account terms used to calculate Subscription Fees may include factors such as the maximum number of monthly quotes, business features and options, the number of users, service response times, API or MCP usage allowances, and other Account Limits. Subscription Fees are non-refundable, regardless of usage levels or whether the account is discontinued during the Subscription Period, except as expressly provided in Section 10.7. Payments are charged in advance, either monthly or annually, based on the chosen payment plan, on the day of Account signup.
10.3 Subscription Payment Processing
Payments are processed through third-party payment processor Stripe. GETT3D is not responsible for any actions or omissions by these third parties. By providing payment details, users authorize GETT3D or its Payment Processors to charge their credit card for all applicable fees, including subsequent renewals, until the Account is terminated.
If payment cannot be processed or is delayed, GETT3D reserves the right to suspend or terminate account access and these Terms.
Annual Pre-Paid Plans: A one-time Plan Upgrade Fee will be charged to cover the cost difference between the monthly pre-paid plan and Upgraded Fees for the unused portion of the Subscription Period. By using the Service, users authorize GETT3D or its Payment Processors to charge their credit card for accrued Plan Upgrade Fees on the monthly billing day.
10.4 Automatic Renewal
Subscriptions automatically renew at the end of the Subscription Period for the same duration specified in the initial purchase invoice. Renewal fees will be based on the higher of:
- The initial Subscription Fee; or
- The new current rate for your tier level (adjusted fee).
10.5 Fee Adjustments and Changes
All Subscription Fees are subject to change. Thirty (30) days' notice will be provided for new rates, which will be applied automatically on your automatic renewal date.
10.6 Renewals and Cancellations
To ensure uninterrupted service, subscriptions automatically renew unless canceled before the end of the current Subscription Period. Payment for renewals will be charged to the credit card provided at registration without additional notice. Monthly subscriptions will renew at the applicable rate for the subsequent month, and yearly subscriptions will follow the same renewal process.
To cancel your subscription, submit a written request on your company's letterhead to GETT3D's designated contact email. Cancellation requests must be submitted before the last 30 days of the current Subscription Period to avoid automatic renewal. Any unpaid fees due until the Subscription Period ends remain payable, and refunds will not be provided for unused service time. You may continue using the Service until the expiration of the paid period. If not canceled, the Subscription Period will automatically extend for 12 months for annual users or 30 days for monthly users following the initial or subsequent term.
10.7 Termination
Your access to the AutoQuote3D Service remains active until the end of the Subscription Period unless terminated earlier.
GETT3D may terminate or suspend your account:
- At the end of your Subscription Period;
- At any time with cause, without notice, where you violate these Terms or your conduct is harmful to other users of the Service, us, or third parties;
- Without cause during the Subscription Period, in which case you will receive a pro-rated refund of your Subscription Fee for the unused portion of the Subscription Period.
Upon termination, all licenses granted under these Terms end, and your access through all Access Channels — including the Widget, Web Application, and Programmatic Interfaces — will be revoked.
10.8 Change in Pricing Tier
Occasionally, features of Accounts or their prices may change. If there's a price increase or a significant reduction in features for your subscribed Account, you'll be notified at least 30 days in advance, and the changes will only apply to future renewals of your Subscription.
10.9 Upgrades and Downgrades
- Account Upgrades: Accounts can be upgraded at any time by providing written notice to GETT3D's official email address, at which time the difference between the subscription plans will be charged and the new upgraded account functions activated.
- Account Downgrades: Accounts can be downgraded by written notice to GETT3D's official email address. Differences in cost of plan tiers will not be refunded but will be kept as credit for future renewals. Downgrades may result in loss of data, features, or account capacity.
10.10 Additional Options and Custom Functionality
GETT3D may provide optional modules or features to enhance Service functionality or meet custom requirements. These offerings are optional and may be opted into by agreement, are charged separately from Subscription Fees, and are subject to these Terms unless otherwise stated.
10.11 Requirements to Use AutoQuote3D Services
To access the AutoQuote3D Service, users need a compatible computer or mobile device with reliable internet connectivity. Usage of wireless data plans may incur additional charges from mobile carriers, which are solely the user's responsibility. Users are also responsible for maintaining all equipment and third-party services required for access, including any third-party AI Assistant subscriptions used to connect to the MCP Server.
10.12 Usage Restrictions
Accounts are for individual or single-company use only and may not be resold or shared. Connecting an AI Assistant or your own application to your own account is permitted; providing account, API key, or MCP access to another individual or company is not. GETT3D reserves the right to suspend or terminate accounts found in violation of these Terms.
11. Uploaded Content and Data
As the user of the AutoQuote3D Service, you are solely responsible for all information, data, or materials uploaded, posted, or stored within the platform ("Content"), whether submitted through the Widget, Web Application, or Programmatic Interfaces. GETT3D does not assume any responsibility for this Content. You confirm that you possess the necessary rights to provide this license, and you accept responsibility for any loss or irrecoverable Content during your use of the Service.
Users and their customers are prohibited from uploading or sharing content that is protected by intellectual property rights unless explicit permission has been obtained from the rights owner. GETT3D does not allow Submissions containing hate speech, explicit sexual material, exploitative content, abuse, fraudulent activity, or anything deemed offensive. Additionally, content resembling weapons or weapon accessories, unless they are nonfunctioning miniatures, is strictly forbidden.
It is the user's responsibility to ensure that all Submissions are lawful, reliable, and appropriate. Web Sites associated with the Service must have Terms and Conditions that prohibit customers from uploading content that infringes intellectual property rights or violates applicable laws.
Users agree to assume responsibility for and cover any royalties, fees, damages, or costs resulting from Submissions made by themselves or their customers.
Ensuring the accuracy of your website's data — including sales tax calculations, product pricing, descriptions, shipping charges, contact information, and payment processing — is solely your responsibility, including where such data is created or modified through an AI Assistant connected to your account. GETT3D is not liable for any inaccuracies or related damages. It is your duty to back up essential data, as GETT3D may not retain copies of files or documents shared through the Service.
12. Confidentiality
Confidential Information encompasses all confidential or proprietary information and documentation belonging to either party, whether labeled as such or not. However, it does not include information that becomes generally known through no breach of confidentiality, information already known to the receiving party at the time of disclosure, information lawfully obtained from a third party not under confidentiality obligations, or information disclosed due to legal, regulatory, or court requirements after proper notice.
Both you and GETT3D commit to keeping each other's Confidential Information secure, using it solely to fulfill duties and rights outlined in these Terms. Unauthorized disclosure to third parties is prohibited unless permitted by prior written consent, except for authorized employees or agents with a genuine need to know. Each party must safeguard the other's Confidential Information as carefully as its own, employing at least reasonable measures to prevent unauthorized use or disclosure.
This Section survives termination of these Terms or your use of the Service.
13. Dispute Resolution and Class Action Waiver
Except where stated otherwise, any disputes between you and GETT3D will be resolved exclusively through binding arbitration conducted in Toronto, Ontario, Canada. By agreeing to arbitration, you waive your right to litigate claims in court. Arbitration serves as a replacement for court proceedings and jury trials, with the arbitrator authorized to award the same damages and relief that would be available in a court.
Class Action Waiver. You and GETT3D agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding.
Before initiating arbitration, you are required to provide GETT3D with the opportunity to address and resolve the dispute. To do so, you must email a written notice to GETT3D at legal@autoquote3d.com, including your name, address, a detailed description of your claim, and the specific relief you are seeking. If GETT3D does not resolve the dispute within 45 days of receiving your notification, you may then proceed with arbitration.
This Section survives termination of these Terms or your use of the Service. If GETT3D makes any changes to this Section — except for modifications to the notice address — you may reject those changes and require adherence to the original language in the event of a dispute arising before the change.
14. Governing Law
These Terms shall be governed and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law principles.
15. Severability
If any part of these Terms, except the Class Action Waiver, is deemed illegal or unenforceable, it will be removed, and the rest of the Terms will remain valid. If the Class Action Waiver itself is unenforceable, the entirety of Section 13 (Dispute Resolution) becomes invalid, and disputes will be settled in court.
16. Force Majeure
GETT3D will not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including acts of God, natural disasters, war, terrorism, labor disputes, governmental action, internet or utility failures, or failures of third-party providers (including hosting, payment, and AI service providers).
17. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to the new terms taking effect, by posting the revised Terms on our website and/or notifying you through the Service. Changes will not impact transactions completed before the effective date of the change. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms; if you do not agree, you may cancel your account before the changes take effect. What constitutes a material change will be determined at our sole discretion.
18. Entire Agreement
These Terms, together with the Privacy Policy and any separately agreed order forms or optional-module agreements, constitute the entire agreement between you and GETT3D regarding the Service and supersede all prior agreements and understandings on the subject.
